Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and PolyOrderbooks governing access to and use of our websites, accounts, documentation, and APIs (the “Service”). By creating an account, clicking accept, or using the Service, you agree to these Terms, our Privacy Policy, Acceptable Use Policy, and Cookie Policy.

1. Eligibility

You must be able to form a binding contract and meet any age requirements in your jurisdiction. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. The Service

PolyOrderbooks provides a historical market-data API related to Polymarket markets (order books, prices, metrics, and related metadata). We are an independent product and are not affiliated with Polymarket. Features, endpoints, retention windows, and rate limits may change as we improve the Service. We may offer free and paid plans as described on the Pricing page.

3. Accounts & API keys

  • Provide accurate registration information and keep it current.
  • Keep passwords, sessions, and API keys confidential; you are responsible for activity under your account.
  • Notify us promptly of unauthorized access via contact@polyorderbooks.com.
  • We may suspend or limit accounts that appear compromised, abusive, or non-compliant.

4. Plans, fees & billing

Plan limits (rate, daily volume, history window) are described on Pricing. Paid plans, when checkout is live, renew on the selected interval until canceled. Fees are generally non-refundable except where required by law or we expressly state otherwise. We may change pricing with notice effective for subsequent renewal periods. Failure to pay may result in suspension.

5. License

Subject to these Terms and the Acceptable Use Policy, we grant you a limited, non-exclusive, non-transferable, revocable license to access the Service for your internal research, trading systems, analytics, and applications. You do not receive ownership of our software, branding, or documentation. Market data originates from public exchange sources; your license covers our Service delivery, not ownership of underlying exchange data.

6. Your responsibilities

  • Comply with all applicable laws and these Terms.
  • Do not misuse the Service as described in the Acceptable Use Policy.
  • Do not rely solely on the Service for decisions where inaccuracy could cause material loss.
  • Ensure client applications handle errors, rate limits, and retries appropriately.

7. Data accuracy & availability

Historical data is provided “as is.” Capture gaps, exchange-side changes, clock skew, and processing delays can occur. We do not guarantee uninterrupted, error-free, or complete coverage of every market at every timestamp.

8. Intellectual property

The Service, documentation, logos, and software are owned by PolyOrderbooks or its licensors. Feedback you provide may be used by us without obligation to you.

9. Confidentiality

Non-public Service details and API keys are confidential. Do not publish keys in client-side code, public repositories, or screenshots.

10. Third-party services

Google sign-in and payment processors are third-party services governed by their own terms. We are not responsible for third-party outages or policies outside our control.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POLYORDERBOOKS AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (OR ONE HUNDRED U.S. DOLLARS (USD $100) IF YOU ARE ON A FREE PLAN).

13. Indemnity

You will defend and indemnify PolyOrderbooks against claims, damages, and expenses arising from your misuse of the Service, violation of these Terms, or infringement of third-party rights.

14. Suspension & termination

You may stop using the Service at any time. We may suspend or terminate access for breach, risk, non-payment, legal requirement, or discontinuation of the Service. Upon termination, your license ends; sections that by nature should survive will survive.

15. Governing law & disputes

These Terms are governed by the laws applicable where PolyOrderbooks principally operates, without regard to conflict-of-law rules, except where mandatory consumer protections require otherwise. Courts in that jurisdiction will have exclusive venue, subject to mandatory local law.

16. Changes

We may update these Terms by posting a revised version. Continued use after the effective date constitutes acceptance. If you disagree, stop using the Service and contact us to close your account.
